Be Careful What you Wish For...

A recent decision by the Canadian International Trade Tribunal puts a spotlight on mandatory criteria in solicitation documents. It serves as a reminder that no matter our intentions, we must only evaluate in accordance with what we wrote and distributed to bidders!

Preview: To help public sector managers better Conduct a Bid Evaluation, RFPSOLUTIONS developed the Bid Evaluation Orientation Guide. Bid Criteria create the roadmap for communication between the buyer and the seller. Criteria identify the key elements of what the buyer seeks and enable the seller to determine whether they can meet those needs while providing direction on how to market their product. For any map to have value it must be accurate, complete and relevant, providing neither too much nor too little detail.  A bad map can cause confusion, induce time delays due to misdirection, excessive traffic and accidents, or be disregarded altogether.

We would like to thank everyone that attended the recent Canadian Institute for Procurement and Materiel Management 23rd annual CIPMM National Workshop.

The CIPMM organizing committee, the session presenters and all of the attendees from the public and private sectors all supported what we feel was one of the most successful workshops yet.

A special thank you to all the attendees that stopped by our booth and showed their support for our "I Love Procurement" Sticker Campaign.
We were thrilled with the number of attendees that participated and we also want to thank the Heart and Stroke team for their work to raise awareness for an important cause.

With your support we handed out more than 200 stickers at the workshop and while we did not reach our goal of a sticker for every attendee, out of appreciation for the huge response, we have donated the full goal amount of $400 to the Heart and Stroke Foundation.

We all feel the same way about procurement, and we thank you all for helping us spread the love.

What We Learned

All of the concurrent sessions presented during the CIPMM conference were both interesting and professionally enriching.
__
For those that didn't make it to all the sessions, here are some highlights from select sessions:

Tackling the Problems of Doing Business in the Digital Age - Forensic Science and Innovation Weigh In, was an awesome session moderated by Tanay Patel of DFAIT. Samiah Ibrahim (CBSA Manager, Forensic Document Examination) was a great speaker and covered very interesting CSI-like techniques and touched on the challenges of going paper-less and what a "signature" might become in a digital age.

Shaping Procurement Together, was a very positive session presented by OSME Director General Shereen Benzvy Miller that focussed on new commodity management initiatives, procurement strategies for goods and services to simplify access to federal procurements, and bringing supply and demand together.

Green Procurement, An Enabler to Meet Government Priorities was a proactive session presented by PWGSC's Margaret Bailey, Policy Development and Cindy O'Driscoll, Acting Team Leader on new integrating environmental considerations into procurement and materiel management processes supports priorities like; reducing cost, achieving efficiencies, increasing collaboration, and sparking innovation.

Cutting Edge Governance and Public Private Partnerships by Marcel Chiasson Director at the Institute on Governance was an insightful presentation on the challenges that in the next decade, will cut across institutional or operational divisions related to demographic, economic, and fiscal transformations.

CIPMM holds up to 4 sessions a year which consist of presentations, panels, armchair discussions and videoconferences on topics of interest to the materiel management, fleet management and procurement communities in the National Capital Region.

 RFPS supports these important sessions as they serve as a rare opportunity for public and private sectors to meet to exchange topical procurement information and often shed light on practical solutions to problems currently facing the two procurement communities.

One of the more innovative solutions we've encountered at a recent CIPMM Breakfast Session (sponsored by RFPS) was an

The session focussed on the program's unique approach to procurement, the key stages of the BCIP process, and the newly added military component. 

Announced in Budget 2010 and made permanent in Budget 2012, BCIP supports Canadian businesses by procuring and testing their late stage innovative products and services within the federal government before the company launches them into the commercial market.

What Else is New
__
The ground might still be frozen outside, but here are some highlights on what has been blossoming in the field of procurement:

ON New eTendering Solution
Starting in March 2014, Supply Chain Ontario, on behalf of the Ontario government, will begin transitioning to a new electronic tendering (eTendering) solution, replacing the services and site currently provided through MERX Networks Inc.
__
These services include access to Ontario government open procurement opportunities such as requests for tenders and proposals for goods and services.With the new BravoSolution eTendering solution, vendors:
  • will have access to Ontario government procurement opportunities for goods and services
  • will be required to undertake a one-time registration prior to downloading or accessing procurement documents
  • will not be required to purchase a subscription to access and review procurement documents.

Trade Agreements: Thresholds Update
The thresholds in effect from January 1, 2014 - December 31, 2015 for procurements subject to various international trade agreements are set out in a table published on the Treasury Board of Canada Secretariat (TBS) website. While the thresholds for the Agreement on Internal Trade (AIT) have not changed, all the others have been updated.

We would like to thank everyone that attended the recent Canadian Institute for Procurement and Materiel Management 24th annual CIPMM National Workshop.

The CIPMM organizing committee held a truly informative and exciting program this year and we were thrilled at the turnout from the private and public sectors. We want to thank the CIPMM organizing committee, the presenters and attendees for coming together for another fantastic workshop.

We especially would like thank those of you that stopped by our booth and showed their support for our 20 Years Young @ Heart Donation Campaign.
We were elated at the support from attendees that participated and we also want to thank the Heart and Stroke team for their work to raise awareness for an important cause.

With your support we received over eighty (80) $2 Donation Cards, raising over $160 at the workshop and while we did not reach our goal of a donation on behalf of every attendee, out of appreciation for the huge response, we have donated $400 to the Heart and Stroke Foundation.

This year RFPS is 20 Years Young @ Heart and we appreciate all your help in support of the wonderful work at H&SF!

What We Learned

For those that didn't make it to all the training sessions, here are some highlights from select sessions:

Debriefing Bidders
This training session, presented by Richard Denault (PWGSC), looked at various aspects of debriefing bidders. It touched on activities involved in the debriefing process as well as pre- and post-activities. It also looked at some of the potential areas of risk and touched lightheartedly on the psychology involved in this process.
Selection Methodologies
This training session, also presented by Richard Denault (PWGSC), looked at how you determine best value when evaluating bids. This training session aimed to answer this question by looking at various best practices when it comes to weighting factors, selection methodologies, and scoring grids. Although a variety of scoring methods exist, many contracting officers are not aware of how or when to use them.

Building Aboriginal Procurement Business Partnerships
This session, presented by Brad Cline (AANDC), focussed on how Federal Procurement Officials can assist Aboriginal businesses in enhancing their opportunities to bid and win federal contracts. Aboriginal Affairs and Northern Development Canada (AANDC) has a number of levers, along with the Procurement Strategy for Aboriginal Business (PSAB) that can be used to enhance Aboriginal business capacity and opportunities.

How to Evaluate Tenders in an Equitable and Transparent Manner
This session, co-presented by Gabriel Cormier(DND) and Paul Tormey (PWGSC) presented two sub-sessions to the bid evaluation process in a competitive environment. The first part addressed a more theoretical aspect of the process while the second covered "blue-collar type" services for the establishment of a Standing Offer.

Transforming Government to Meet New Fiscal Realities
This session was presented by Marcel Chiasson(Institute On Governance). With fiscal restraint and continuing pressures to transform how government does business, IOG presented on how to address these challenges through fostering innovation, breaking down traditional working silos and seeking out new collaborative opportunities across jurisdictions, sectors and delivery partners can create a framework for transformation. The need for transformation comes with the need for change. The degree of change is dependant on the scope and timing of the shift.

The time has come once again for the annual CIPMM National Workshop, which will be held on May 5th - 8th, 2014 at the Ottawa Convention Centre.

RFPS Article: What is Procurement
At the conclusion of International Public Procurement Conference - IPPC5 in 2012, a challenge was set by RFPS' Jonathan Mak to departing participants to define "procurement." There does not seem to be a single, obvious answer, with definitions perhaps differing with the respondent and their relation to the topic. Is a single off-the-shelf purchase "procurement"? What if it is part of an overall strategy? Is "procurement" achieving contracts, outcomes, or something else? The answers to these questions, and others, are extremely important to those affected by the discipline. Author Jonathan Mak explores this broader topic of the nature of "procurement," in general and in terms of "public procurement," in order to frame the discourse on procurement, and to examine what it may mean for those in and around the field.

Intellectual Property in Federal Crown Procurement Contracts Clarified

Effective April 1, 2015, the Policy on Title to Intellectual Property arising under Crown Procurement Contracts has been updated to further assist federal departments and agencies in identifying IP generated in procurement contracts and confirming its potential for commercial exploitation. As previously, with the aim to assist in further commercial development of Intellectual Property (IP), any IP generated under a Crown Procurement Contract remains the property of the Contractor, unless a valid exception is taken within the procurement and contract documents. The Policy remains focused on identification and management of new IP (“foreground”) which may be created in the course of work under a procurement Contract, and does not impact on existing IP of the Crown or the Contractor (“background”). The revised policy includes a new reporting requirement for federal officials to support development of an annual report on ownership of IP and its potential commercial exploitation.

Did you know...?  Canada - Korea Free Trade Agreement is in effect 

Effective January 1, 2015, buyers in the federal public sector are navigating the application of Canada’s latest bilateral trade agreement to its Procurement and Contracting activities. The Canada-Korea Free Trade Agreement applies to procurement and contracts of covered Goods and Services valued at $100,000 (CAD) or greater, and Construction valued at $7.7 Million* (CAD) [*note the value threshold for Construction will be adjusted every two (2) years]. The Agreement covers most Goods, and a broad range of professional and operational services.  While there are common provisions between the WTO-Agreement on Government Procurement and the Canada-Korea FTA, procurement officials should review the Agreement at Chapter 14 to ensure their procurement strategies take the CKFTA into account.

With spring comes the 2013 CIPMM National Workshop, to be held on May 7th - 9th, 2013 at the Ottawa Convention Centre.

RFPSOLUTIONS will be set-up in the trade show area on May 8th and 9th, and we cannot wait to catch up with our clients on what is new in their procurement worlds and we look forward to meeting new visitors as well.

Saskatchewan's Ministry of Central Services (CS) is seeking information from suppliers for the potential provision of an Electronic Tendering System (ETS), and potentially a complete electronic purchasing system.
Central Services' objective of this Request for Information (RFI) is to solicit information from suppliers on a commercial off the shelf (COTS), custom solutions or supplier hosted solutions (Software as a Service) to provide this service (RFI #5344 on www.sasktenders.gov.sk.ca).

Changes to Taxes Applicable on Contracts:
Effective April 1, 2013, new sales tax provisions come into effect in British Columbia, Quebec and Prince Edward Island which may affect crown procurement contracts. Big Thanks to You! 

At the recent annual CIPMM National Workshop, held on May 5th - 8th, 2014 at the Ottawa Convention Centre, we joined CIPMM in celebrating its 25th Anniversary.

The theme of the Workshop was "Reflections on the Past - Directions for the Future", and the CIPMM Organizing Committee delivered an exceptional event that presented thought-provoking procurement events and facts from the last 25 years.  The speakers and topics were inspiring and professionally enriching.

RFPS was set-up in the trade show area and we thoroughly enjoyed exchanging procurement stories, tools, and tips with the participants and inviting visitors to step right up and play The Big 25Heart and Stroke Foundation Donation (H&SF) game!


Check our Donation Meter which shows that we met our goal to raise a donation of $2-$5 for everyone at CIPMM.  Thanks to your help, we were able to donate our full goal of $400 on your behalf to support the important work done by the H&SF.

Thank you so much to those that stopped by our CIPMM booth and experienced what a difference 25 cents can make in the fight against Heart Disease and Stroke!

Each of the concurrent training sessions presented during the CIPMM conference was both interesting and professionally enriching.

1 - Understanding CORCAN

Presents a list of key questions that people involved in the procurement and management of materiel should ask themselves when any toxic substance is present, showed in a practical way the scope and impact of CEPA, 1999 regulations. 

5 - Transforming the Way We Buy - PWGSC's Acquisitions Transformation Program
Presented by: Emilio Franco, Ken McMillan, Jessica Wright, PWGSC
The purpose of this session is to familiarize participants with the new Acquisitions Program Transformation (APT) approach and the supporting digital strategy.

Why are SOW's so difficult to develop?

A well-written SOW is the cornerstone of an effective RFP, but they are difficult documents to develop.

SOW's are always unique to a specific contract, and they can vary significantly depending upon the type of work required, the duration, the contract mechanism being established, and many other factors.

Unfortunately, there are few clear rules to define what a good SOW looks like and no real roadmap for managers to follow.

Jonathan Kealey, a manager at RFPSOLUTIONS, wrote an article on this topic in a recent issue of the Financial Management Institute (FMI) Journal.

Procurement Reporting for Calendar Year 2011has been posted by TBS. Each year, organizations are asked to provide PWGSC with data on their contracting activities.

CLCAs (Comprehensive Land Claims Agreements) are modern treaties which detail a government-to-government relationship between the Aboriginal signatory and the Government of Canada as well as, in some cases, the associated provincial or territorial government. Tona Locke, IM Research Analyst at RFPSOLUTIONS, wrote an article on this topic in a recent issue of the Summit Magazine.

2012 - Ontario - Toronto Transit Commission (TTC) / Metrolinx - Crosstown Rapid Transit System

From December, 2011 - May, 2012, RFPSOLUTIONS was contracted by Metrolinx and the Toronto Transit Commission (TTC) to serve as Fairness Monitor, overseeing the Request For Pre-Qualification (RFPQ) development process and Bid Evaluation associated with a procurement process for Tenders for the construction of the Western Tunnel contract in support of the Crosstown Rapid Transit system

RFPSOLUTIONS conducted a review of the RFPQ package; and provided feedback to ensure an open, fair and transparent competition process that did not favour one supplier over another and meets the Ontario Management Board of Cabinet Procurement Directive and Metrolinx Procurement Policy.
